Bryan Berard In A Legal Battle With Insurance Company

from Julia Marsh of the New York Post,

A former NHL All-Star who played for the both the Rangers and Islanders is entangled in a legal faceoff with an insurance company over an $18 million payout.

Standard Security Life went on the offensive against retired defenseman Bryan Berard Thursday, filing a Manhattan lawsuit after the stick handler accused the company of fraud, according to court papers.

Standard sued to preempt threatened litigation by Berard, the suit says.

Berard got a $6 million insurance settlement from Standard in 2001 after suffering a seemingly debilitating and career-ending eye injury in March 2000....

Berard retired in 2009. But then in 2013 he hired an attorney and came after Standard saying he never should have had to repay the insurer.

He is demanding $18 million in benefits, interest and penalties, claiming the agreement to relieve Standard of future claims was a fraud.

You can see both sides point…

If the insurer paid the claim on the basis that the injury was career ending and it wasn’t then you can see why they would want a repayment. That said, Berard was legitimately injured and permanently disabled and it could be argued was never the player he might have been otherwise due to the injury.

This screams out for a settlement, but its easy for two sides with good positions to get entrenched.

Sorry, but I really dislike (most )lawyers and insurance companies. I don’t know anything about this case ( other than Berrard nearly had his eye gouged out) , but most insurance companies and their hired lawyers are, in my opinion, a bunch of D-Bags.

On behalf of lawyers everywhere, Down River Dan, we’re sorry you feel that way.
