Can Sports Betting Land Me in Trouble in the US?

11/29/2018 at 6:30pm EST

It’s hard to believe but this time last year placing a bet on a sports match could have landed you in trouble in many states across the USA. This was thanks to a law enacted in 1992, The Professional and Amateur Sports Protection Act (PASPA).

This legislation governed how sports betting was to be handled in all but two states in America for the next 26 years. The only states exempt were Oregon and Montana because these states already had laws in place governing the practice.

To say that PASPA was considered controversial is putting it mildly. It came to be seen as an infringement on personal liberty in those states that wished to allow the practice. You can see how that process progressed in this infographic.

Eventually, the case was put before the Supreme Justice. Six out of the nine judges agreed that the law was not in keeping with the constitution. They ruled that each state had the constitutional right to decide on the matter for itself.

So far, the only state to come out strongly against the ruling was the state of Utah. It decided that the practice of sports betting would be considered illegal. Which is hardly surprising – gambling is still considered something of a vice in the more conservative areas of the country.

But Utah is alone in its complete condemnation of the practice. A few states like Nevada and Pennsylvania were quick to make changes to their legislation after the ruling. Other states would follow suit by filing bills of their own, but not all the bills have passed as yet.

Overall, though, in most of the country, the future of sports betting looks rosy. Just don’t try to place a bet on the Utah territory – that could still get you arrested. We recommend that you check the legal status of the industry in the state that you’re in just to be on the safe side. If it is, have some fun and try to pick a winner.
