The Kraken Bar & Lounge vs. The Seattle Kraken

A University District punk-rock bar is suing the Kraken for $3.5 million, alleging the NHL expansion team’s name choice and plans to open a Northgate Mall practice facility restaurant risks irreparably harming its brand.

A lawsuit filed Thursday in King County Superior Court states the Kraken Bar & Lounge, founded in 2011 by William Knupp and husband-and-wife Kat Colley and Daniel Colley, had begrudgingly tolerated the team’s name choice despite a parade of new patrons in “hockey themed attire” showing up amid its usual music clientele wanting to make the venue their hangout. But the final straw, according to the lawsuit, came when the team this month announced it will open the Kraken Bar & Grill at its planned $80 million training facility come mid-September.

The lawsuit for trademark infringement and tortious interference asks that the team be prohibited from using “The Seattle Kraken” name and any others similarly confusing with its own trademarks.

So you were going to tolerate the team name, and now want them to not use it at all? Come on. The restaurant thing I get. But the whole team name is infringement because you had *more* people coming to your establishment?

You didn’t know what to do with the extra customers?

And that the team’s “blitzkrieg advertising campaigns” had caused the bar’s online and social-media presence to drop “to a location only the most dutiful or mindful consumer could find.”

So do you want do maintain your “dive bar” status or not?

I kind of feel for them but yeah it’s a little incoherent a complaint.

I can see their frustration at having chosen the name and developed an
identity around it way before the hockey team chose to adopt it.

And I totally get how niche bar owners and regulars feel when their
special retreat is overrun by groups of people showing up as a gimmick.

I’m not going to track the exact chronology of what happened when, but
“We were here first and our name, brand, and identity are being wiped off the digital map” doesn’t work so well with: “too many new people are finding us now.”
