Clarkson May Appeal His Suspension

Toronto Maple Leafs forward David Clarkson is considering appealing his 10-game suspension.
Clarkson was automatically assessed the ban when he left the bench on Sunday night to participate in a brawl with the Buffalo Sabres.
Because Clarkson's suspension is more than five games, the appeal process could include an independent arbitrator.
Any appeal would first be heard by NHL commissioner Gary Bettman, but if he were to uphold the suspension, Clarkson could bring the appeal to an arbitrator.
The suspension to me is pretty much black and white. He left the bench and became involved in the brawl. End of story.

I agree, guys. It seems pretty clear…I am curious to see what, if any, legitimate argument he has.

The only argument I can see that he can use is that he didn’t engage in any fisticuffs.
But that doesn’t matter. He left the bench to engage in the scrum making it an odd-man situation.
Buffalo could have easily responded in kind and all hell would have broken loose.
There’s no excuse for what Clarkson did.
I honestly don’t think he’ll be good as a Leaf. I think he’ll try too hard to be the next Wendel Clark and spend more time looking for fights than playing his game.
Wendel never looked for fights, he only finished them.
The rest of the game, he threw the body and sniped goals.

There are a few issues at play here and I don’t think any of them are truly intended to prevent Clarkson from serving 10 games.
The NHLPA wants to try out the appeal process for a long suspension now that they actually have one that doesn’t involve Bettman’s ultimate decision.
The NHLPA also wants to make it perfectly clear that the consideration of “automatic” suspensions such as this one needs to go through them first, even if they essentially signed off on the 10-game suspension for leaving the bench when they signed the CBA.
There may be some gaming going on as far as trying to prevent suspension overlap with Clarkson and Kessel.
I don’t think they’re truly trying to weasel out of punishment, but I also don’t feel that this is really a waste of time.

The player remains suspended while the appeal is pending, so there’s no delay involved.
