Attorney For Accuser In The Patrick Kane Case Has A Lot To Say

An attorney for the woman who has accused Blackhawks star Patrick Kane of sexual assault claimed the police evidence bag containing the accuser's rape kit showed up on her mother's doorstep, an explosive allegation that could taint the ongoing investigation.

Criminal Defense attorney Thomas J. Eoannou said the accuser's mother noticed the brown bag on her doorstep when she returned home from work around 1:30 p.m. Tuesday. At a news conference in Buffalo, he provided a photograph of the purported bag, which contained the accuser's name as well as the initials of the nurse who performed the evidence collection at the hospital in Erie County.

The Tribune could not immediately confirm its authenticity, and it was unclear if the attorney had confirmed it with the authorities.

Eoannou called for an independent investigation, while acknowledging it will hinder the prosecution's ability to move forward with the case.

"If you're looking for a sure-fire way to scuttle a prosecution, you tamper with evidence," Eoannou said.

It’s one thing for a defense attorney to say a baseless allegation: It’s a whole other when they throw the evidence on the table for the press (tell the world the nurse that administered the test authenticated the signature on the evidence) and ask the FBI to get involved.

Now we know how that leak of Kane’s DNA being found only on the victim’s fingernails and shoulder occurred.

Now it appears 2 people will be going to prison. I wonder how many millions Kane authorized his defense team to spend and who did what.

Hamburg Police with a statement via Facebook.

In regard to the information conveyed today by Mr. Thomas Eoannou, the Hamburg Police Department will cooperate with any authorized investigation regarding the handling of evidence and the procedure of such.  That said, The Hamburg Police Department has documentation that unequivocally demonstrates that it’s handling of the evidence and the integrity of it’s chain of custody of evidence in this case is unassailable.  As is policy with active investigations, there will be no further comment regarding this situation.

We can now add possible skullduggery to the Patrick Kane case, as if ugly accusations, postponed grand jury proceedings and news-conference awkwardness weren’t enough.

The attorney for the woman who has accused the Blackhawks star of sexual assault said Wednesday that an empty bag once containing her rape kit had been anonymously dropped off at the home of the woman’s mother, putting the integrity of the evidence in serious question.

“The purpose of an evidence bag is to protect the items of evidence from tampering,’’ Thomas Eoannou said. “The bag itself is even critical evidence to the chain of custody. It never leaves law enforcement or the district attorney’s office.’’

Gentlemen, start your conspiracy theories.

So either there is a conspiracy to bring down Patrick Kane perpetrated by an anonymous accuser, a lawyer and at least one police officer, or a millionaire hockey player paid one of his cop buddies to destroy evidence that, at least upon preliminary examination, would have helped his case in a grand jury trial.

Gentlemen, start your conspiracy theories.

Well, let’s start with this one. If evidence goes missing from a crime lab, you first have to ask who could gain access to the lab or who might have contacts within that lab. And then you have to factor in who Kane’s limo driver was the night of the “incident” – a Buffalo Police lieutenant who’s a personal friend of the family.

That’s not necessarily true, Hoot. Supposedly the evidence showed no semin present. That doesn’t mean a rape didn’t occur. Individuals afraid of fathering children have been known to use condoms.

While it doesn’t mean a rape didnt occur, if the exam showed what has been reported, it is a piece of physical evidence in Kane’s favor, which would help his case.

Well, choose your pile of doodoo:

1. Kane conspired with a person in the police lab to sabotage potentially incriminating evidence to help him get off.
2. Someone in the police lab on their own initiative thought the world would be better served by sabotaging evidence that may incriminate Patrick Kane.

If I’m not mistaken, the only report I saw was that there was no semen present. They didn’t say there was no spremacide present (like threre might be from a condom).

And, unless the accusser is a complete imbicile, why would she go to the hospital and have a rape kit done if she knew she hadn’t had sex?

There’s a lot of weird non-information in the stuff that’s come out since the presser.

The Hamburg police say that THEIR handling of the chain of custody is unassailable.

What they did NOT say is that there’s absolutely no chance the bag went missing or was mishandled, since the DA is not the Hamburg police and that office could reasonably have it and since the Erie County Central Police Services could be different from the Hamburg Police.

The Erie Count Commissioner of Central Police Services says they have the evidence bag and everything is in it’s original packaging.

What he did NOT say is that they have always had the bag accounted for and that the original packaging is entirely intact.

They also did NOT say there’s no evidence that the evidence they have has not been tampered with.

They didn’t say what happened to the bag that Eoannou showed to the press; meaning they didn’t say if it was the same bag or a different bag.

Assumptions fly in an information vacuum.

A change of venue might well be optimal for the accuser but I’m unaware of any basis for changing venue based on alleged police bias (though police actions could perhaps be argued as part of the motion), and even if venue did change, the evidence would still have gone between the hospital and local PD.

Today’s revelation show at least one crime has been committed (in addition to the sex offense/rape). This is either evidence tampering, witness intimidation or both. Given Kane’s connections to the local PD, oversight is absolutely essential at this point.

Las Vegas alone has a 10-year backlog on rape kits.  That’s 6,600+ kits that have not been investigated.
