The videos the DoPS issues are not nothing but they don’t explain
clearly or consistently in a comparative way why one hit is suspendable and another one isn’t. It seems more like they make a decision and then try and justify it as best they can with each incident.

Burke just asserts that NHL players know based on these videos what exactly is suspendable and what isn’t. Maybe he wants to believe that they should know.
But it’s clearly not the case that most or certainly all players do understand the rules and know, from one hit test is punished to another very very similar that is ignored what the standards actually are in a prescriptive sense from which they can adjust how they play. Kane has probably been the most blunt about this confusion but many other players have expressed confusion and frustration, too.

Burke reveals that the NHLPA wanted a third party to make these decisions but the league refused. No surprise - they are my way or the highway control freaks. Doesn’t mean it wouldn’t help at least remove the bias of personal relationships and favoritism toward certain teams. Nor does it matter that other leagues are also run by control freaks who also don’t want to give up exclusive power to interpret and punish. Doesn’t mean either or any are right on the merits. He also claims Kane would immediately complain if a third-party ruling went against him. Maybe, maybe not. Again, Burke is refusing to engage with Kane’s argument that a third-party is needed to avoid bias and favoritism within the league.

Maybe this is why: he concludes by getting his dander up that anyone would dare question the great George Parros. Why? Because Burke “had him” in Anaheim(!) And because George got a varsity athlete’s slot at Princeton, so he must be an incorruptible genius beyond reproach. This is exactly why and how the cronyism within the league management is such a problem! Burke is so incensed that insiders like him (he used to do the job himself) might be questioned, that he can’t help giving away the game. Thanks for helping to prove Kane’s point.
