After the definitive pimp-slap he received at the hands of Gary Bettman’s intentionally-made-public preliminary appeal decision, this is the right call.

The NHL released Bettman’s decision because the league hit a home run with it and the NHLPA dropped the ball with the “throw everything and see what sticks” appeal attempt.  Taking this to an independent arbitrator runs the danger of creating the appearance of appealing just to be contrarian without real regard for player safety.

The NHLPA will get their independent test case, but it’s going to have to come after a Bettman decision which isn’t a slam dunk.
