NHL’s Owner-GM Resolution Policy Faces Challenge

The NHL's constitution states the Commissioner shall have exclusive jurisdiction when it comes to these disputes. However, Bettman's "exclusive jurisdiction" has been shelved in favour of a Canadian court in one case and this has general managers around the league buzzing. Without attacking Bettman's objectivity, he works for the owners. And many of the general managers contacted by TSN believe third party arbitration needs to be taken outside of the league's headquarters to determine executive disputes. Former Ottawa Senators general manager Marshall Johnston has done exactly that. Johnston, who left the team in 2002, will have his civil case heard in an Ontario court on Dec. 5 in Ottawa.
